Lasting Power of Attorney
Lasting Power of Attorney
A Lasting Power of Attorney (LPA) is a vital legal document that allows you to appoint someone you trust to make decisions on your behalf if you become unable to do so. At Inherisure Limited, we understand the importance of planning for the future and ensuring your wishes are respected.
What is a Lasting Power of Attorney?
An LPA is a legal document that lets you (the ‘donor’) appoint one or more people (known as ‘attorneys’) to help you make decisions or to make decisions on your behalf. This provides you with more control over what happens to you if you have an accident or an illness and cannot make your own decisions (you ‘lack mental capacity’).
Types of Lasting Power of Attorney
There are two types of LPA:
1. Health and Welfare LPA
This allows your attorney to make decisions about your daily routine (e.g., washing, dressing, eating), medical care, moving into a care home, and life-sustaining treatment. It can only be used when you’re unable to make your own decisions.
2. Property and Financial Affairs LPA
This allows your attorney to make decisions about your money and property, such as managing bank accounts, paying bills, collecting benefits or a pension, and selling your home. With your permission, it can also be used as soon as it’s registered.
Why You Need a Lasting Power of Attorney
Setting up an LPA offers several key benefits:
- Control: Ensure that your wishes regarding your health, welfare, and finances are followed.
- Peace of Mind: Know that someone you trust will make decisions in your best interests if you are unable to do so.
- Avoiding Court: Without an LPA, your loved ones may need to apply to the Court of Protection to gain the authority to act on your behalf, which can be time-consuming and expensive.
“Power of Attorney is not just for the elderly. Everybody … should be considering one. I’ve had one for a decade now. I have no foreseeability of losing my faculties.”
